GENERAL CONDITIONS AND CONDITIONS OF SALE FOR THE USE OF «READY»

«Ready» is an e-commerce space accessible online created by, and owned by, StreetLib Srl («SL»), with registered office in Corso Venezia n. 10, 20123 Milan (MI), Italy, tax code and VAT number 05338720963, email address (PEC): simplicissimus@pec-mail.it, REA MI-2094063, which allows authors and publishers («Users») to purchase, for their own works and for professional purposes, the editorial services and/or related marketing and merchandising services offered by SL. Ready is accessible online from the SL website https://readybooks.io/ , built by SL itself through the hosting company Shopify ( https://it.shopify.com/ ).

Navigation and use of Ready by Users involves access by the aforementioned subjects within the IT environment of SL, which SL shares with Users to allow them to view and purchase services. To this end, acceptance of these General Conditions and Conditions of Sale is required, which the User therefore declares to have examined and accepted, binding themselves to the provisions contained therein.

SL does not provide any guarantees, explicit or implicit, in relation to the functionality and suitability of Ready and/or the services offered with respect to the needs and expectations of the User.

1. Access to Ready and Conditions of Sale

The purchase of SL services through Ready is reserved for Users exclusively with regard to the works, extracts or partitions, logos, brands, concepts, contents etc. of which the Users themselves are the owners of the relative rights. The use of Ready is not permitted to minors under the age of 18 without the intervention of a parent or guardian.

The User can access Ready through the website owned by SL https://readybooks.io/ . The User can proceed with the purchase as a registered User, through his/her personal account, or as an unregistered User, in this case entering the data necessary for SL to process the order.

In both cases (with or without registration), the User releases the data and information requested by the system under his/her own exclusive responsibility and with the obligation of the broadest indemnity towards SL for any prejudice that may occur in relation to the untruthfulness, inaccuracy or incompleteness of the data communicated. The User therefore undertakes to provide correct and truthful information and to inform SL promptly in the event of changes to such information.

For the purposes of the purchase procedure, the User agrees to receive communications from SL in electronic format (email) and acknowledges that the relevant records on SL's systems are valid in relation to the communications exchanged.

The User acknowledges and takes note that for some of the services offered by SL on Ready it is necessary to upload to the platform, or send to SL via email, the file of the work or content in relation to which the service is requested. Therefore, when the User places the order, he authorizes SL to carry out, in relation to the aforementioned file, the interventions necessary for the provision of the purchased service. SL will keep the contents uploaded by the User confidential, which will be used by SL exclusively for the provision of the service. The User authorizes SL to use its own selected partners for certain aspects and activities inherent to the correct fulfillment of the order.

The User will receive an email from SL confirming receipt of the order, containing the details of the order. The User's order constitutes acceptance of the offer for sale of SL's services, with simultaneous authorization to SL to collect the relative price. For some services whose cost varies in relation to the characteristics of the work or content and/or the specific requests and needs of the User, SL will send the User a cost estimate that the User will be free to accept or not. The forecasts regarding the fulfillment of the order do not constitute guaranteed execution times. The prices and additional commercial conditions applied are displayed on the platform in consideration of the specific services requested and the orders prepared by the Users.

Payment for purchased services may be made by the User by credit card through the Shopify Payments system or with other payment methods made available by the platform.

SL stores the purchase order in its computer archives and allows the User to review the orders through the account or, by contacting customer support, through the email address provided for the purchase.

2. Using Ready

The User has the right to use Ready exclusively in compliance with these General Conditions and Conditions of Sale.

The User undertakes to use Ready according to the technical rules highlighted from time to time on the site and in any case for lawful purposes and in compliance with the normal use of the purchasing system, under his/her own exclusive responsibility and in compliance with any law, regulation or practice in force in the Italian territory or in any other jurisdiction from which access is made possible.

In particular, the User undertakes not to use Ready in ways that may or are suitable to:

• interfere with its normal functioning;
• enable the performance of illegal or fraudulent activities;
• cause harm to third parties.

The User acknowledges and takes note that for certain services available on Ready it may be necessary to communicate to SL and process by the latter data of third parties available or otherwise acquired by the User or even by SL on behalf of the User. The User therefore undertakes to guarantee towards SL and said third parties compliance with all regulations and standards applicable to the collection, archiving, communication and processing in general of the aforementioned data.

Failure to comply with the obligations undertaken by the User may result in the suspension of operations and/or blocking of access to the account, as well as the cancellation of orders without charges or costs for the User, without prejudice in any case to compensation for damages caused to SL.

3. Links to other websites

The User acknowledges that Ready may include links to third-party websites, in relation to which SL assumes no responsibility or guarantees with reference to the functioning, content, services offered and/or any other information present therein. Any access or use of such websites by the User is the User's responsibility.

4. Industrial property and data

The User acknowledges and recognizes that brands, images, graphic signs, logos, processes, contents and in general any industrial property, inherent to Ready, are the exclusive property of SL. In no case, the use of Ready by the User can be understood as a transfer or license on the industrial property of SL.

The User is prohibited from copying, modifying, altering, publishing, disseminating, distributing, selling or otherwise transferring, in whole or in part, any element of Ready, as well as any use that may prejudice the industrial property rights of SL. Any data present on Ready may be downloaded, printed or copied by the User exclusively for uses strictly connected to the use of the sales system.

5. Security and protection of the User's personal data

In case of account registration, the access credentials (email and password) are kept by the User, are strictly personal and must not be communicated and/or shared with other parties. If there is reasonable doubt that the credentials have been used, or may be used, by third parties, the User must immediately change the access password, communicating the incident to SL. In case of impediment of the User, the password may be cancelled by the system administrators and replaced with a new password. The new password will be communicated by the system administrator to the User, who must change it upon first access.

All information provided by the User through data registration and use of Ready, as well as information and data that are in any way referable to the User (including login credentials and/or payment information), are maintained and processed through secure computer systems. SL specifically states that the data is stored on the servers of the hosting company Shopify, through which the site was built. SL also states that the data is processed through standard tools and practices that provide an adequate level of computer security, however SL itself cannot guarantee that the systems are free from the possibility of cyber attacks.

Payments through Ready are protected by an advanced online data defense system. Payment by credit card takes place on secure servers managed by the hosting company Shopify. SL does not have access to the credit card data and/or the User's current account, managing only the data for the execution of the service purchased through Ready.

The User's personal data are processed in accordance with the current regulations (GDPR 2016/679; Legislative Decree 196/2003 and subsequent amendments, in particular those introduced by Legislative Decree 101/2018) and as specifically indicated in the Privacy Policy viewable in the appropriate section of the site, which the User declares to have read, understood and accepted. In any case, the User recognizes and acknowledges that SL, through Ready, has access to the User's data and information, which it may also disclose in the cases provided for by law.

6. Changes to Ready and the General Conditions and Conditions of Sale

SL, for both commercial and technical needs, can make improvements or changes to data, information, images, services, layouts, products and other material present on Ready.

SL may modify these General Conditions and Conditions of Sale. The modifications come into force immediately after publication on the site. The use of Ready after the publication of the modifications implies acceptance of the modified General Conditions and Conditions of Sale, which the User therefore has the obligation to view.

7. Maintenance interventions and network outages

SL will perform periodic system updates and maintenance during which access to Ready may be temporarily unavailable. Likewise, in the event of disruptions or malfunctions of telematic or IT systems provided by third parties, Ready may become temporarily inaccessible.

8. SL's Responsibility

SL is liable to the User exclusively for any damages caused by non-compliance with these General Conditions and Conditions of Sale and provided that such damages were reasonably foreseeable by SL at the time of the User's access to Ready or the acquisition of a service through Ready.

9. User Responsibility and Indemnity

The User is responsible towards SL for the non-fulfilment of these General Conditions and of Sale and undertakes to hold SL harmless with respect to any damage or loss, direct or indirect and of any kind, which may arise to SL itself or to third parties as a result of said non-fulfilment and/or in the event of an illicit action or omission in any way carried out by the User through Ready.

10. Applicable law

The law applicable to the relationship between the User and SL is Italian law, together with the community legislation and the international conventions applicable to the service.
